Request Deferred Disposition

Deferred Disposition is a form of probation, which allows for the dismissal of a certain charge if specific conditions are met. The probationary period is usually (90) days and begins when the court has accepted the Application for Deferred Disposition and fees are paid.

Advantages of Deferred Disposition

With the successful completion of Deferred Disposition, there is not a final conviction reported on your driving record with the Department of Public Safety.

To Request Deferred Disposition                      *Juveniles must appear in open court

  • Appear IN PERSON at the court, or by MAIL
    ON OR BEFORE THE APPEARANCE DATE NOTED ON YOUR CITATION.
  • Enter a plea of Guilty of No Contest and submit the 2020 Deferred Disposition Application.docx
  • Pay the Administrative fee at the time of request. (Verify this amount with the court). The deferral period will not begin until the deferred fee is paid.
  • If you are UNDER 25 YEARS OLD you are REQUIRED to take a Driver’s Safety Course during the 90 day probationary period (CCP, 45.051).

Reasons you are NOT Eligible for Deferred Disposition

  • Commercial Driver’s License
  • You were charged with Speeding 25 miles or more over the posted speed limit
  • You were charged with a violation in a construction work zone with workers present.
  • Passing a School Bus
  • Non traffic violation

Failure to Comply with Deferred Order

  • You will be required to appear in open court for a show cause hearing before the Judge and/or;
  • A final Judgment of Guilty may be entered by the Judge.
  • A conviction may be reported to the state as required
  • Additional fees and conditions may be assessed.
